1 Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "Player," or "you") and OpenPH ("OpenPH," "we," "us," or "our"), the operator of the online gaming platform accessible at openph.net and its associated mobile applications and services (collectively, the "Platform").

By creating an account, making a deposit, placing a wager, or otherwise accessing any part of the OpenPH Platform, you acknowledge that you have read these Terms in full, that you understand them, and that you agree to be legally bound by them. These Terms apply to all users of the Platform, including registered players, visitors, and any other persons who access or use the Platform in any manner.

These Terms should be read in conjunction with our Privacy Policy and our Responsible Gaming Policy, both of which are incorporated herein by reference and form part of the overall agreement between you and OpenPH.

2 Eligibility & Age Verification

To be eligible to register and use the OpenPH Platform, you must satisfy all of the following conditions at the time of registration and at all times during your use of the Platform:

• You are at least 21 years of age;
• You are a natural person and not a corporation, partnership, or other legal entity;
• You are accessing the Platform from a jurisdiction where online gaming is not prohibited by applicable law;
• You are not a current employee, contractor, director, officer, or agent of OpenPH, nor an immediate family member of any such person;
• You have not previously been excluded from the OpenPH Platform or had an account terminated for cause;
• You are acting on your own behalf and not as an agent for any third party.

OpenPH reserves the right to request documentary proof of age and identity at any time. Acceptable documents include a valid Philippine government-issued ID (e.g., PhilSys National ID, passport, driver's license, UMID, or voter's ID). Failure to provide satisfactory verification documents within the timeframe specified by OpenPH may result in suspension or permanent closure of your account and forfeiture of any pending withdrawals pending investigation.

2.1 Jurisdiction Restrictions

OpenPH is operated for and directed at players located in the Philippines. It is your sole responsibility to ensure that your use of the Platform complies with all laws applicable in your jurisdiction. OpenPH makes no representation that the Platform is lawful or available in any jurisdiction outside the Philippines.

3 Account Registration & Security

3.1 Registration Requirements

To access real-money gaming features on OpenPH, you must create a registered account. During registration, you are required to provide accurate, current, and complete information, including but not limited to your full legal name, date of birth, residential address, email address, and mobile number. You agree to update this information promptly if it changes.

OpenPH operates a strict one account per person policy. Creating multiple accounts — whether under the same or different identities — is strictly prohibited and will result in immediate termination of all associated accounts and forfeiture of balances, subject to investigation.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your OpenPH account credentials, including your username and password. You agree to:

• Choose a strong, unique password and not share it with any third party;
• Log out of your account after each session, particularly on shared or public devices;
• Notify OpenPH support immediately if you suspect unauthorized access to your account;
• Not allow any other person to access or use your OpenPH account.

OpenPH will not be liable for any loss or damage arising from your failure to comply with these security obligations. Any activity conducted through your account will be deemed to have been authorized by you unless you have notified us of a security breach in accordance with these Terms.

3.3 Account Verification (KYC)

OpenPH is required to conduct Know Your Customer (KYC) verification in accordance with applicable Philippine anti-money laundering regulations. You may be required to submit identity documents, proof of address, and source-of-funds documentation before withdrawals are processed or at any other time at OpenPH's discretion. Accounts that fail KYC verification may be restricted or closed.

4 Deposits, Withdrawals & Payment Methods

4.1 Accepted Payment Methods

OpenPH currently accepts deposits and processes withdrawals via the following payment methods: GCash, PayMaya, BPI, BDO, and Metrobank. All transactions are denominated in Philippine Peso (PHP / ₱). OpenPH does not accept deposits in foreign currencies or via cryptocurrency.

4.2 Deposits

The minimum deposit amount on OpenPH is ₱100. OpenPH does not charge platform fees on deposits; however, your payment provider may apply their own transaction fees, for which OpenPH bears no responsibility. Deposits are generally credited to your OpenPH account within minutes of confirmation by the payment provider.

All funds deposited into your OpenPH account must originate from a payment method registered in your own name. Deposits from third-party accounts are not permitted and may result in account suspension pending investigation.

4.3 Withdrawals

Withdrawal requests are subject to completion of KYC verification. OpenPH targets processing of GCash and PayMaya withdrawals within 15 minutes of approval; bank transfers are typically completed within one (1) Philippine banking business day. These timeframes are targets and not guarantees — processing times may vary due to payment provider delays, verification requirements, or system maintenance.

OpenPH reserves the right to delay or withhold withdrawal processing pending investigation of suspected fraud, bonus abuse, or breach of these Terms. The minimum withdrawal amount is ₱200.

4.4 Currency and Taxes

All balances, wagers, and payouts on OpenPH are denominated in Philippine Peso (₱). You are solely responsible for any tax obligations arising from your winnings under applicable Philippine law. OpenPH does not provide tax advice and recommends consulting a qualified tax professional regarding your obligations.

5 Gameplay Rules & Fair Play

Each game available on the OpenPH Platform is governed by its own specific game rules, which are accessible within the game interface. In the event of any conflict between game-specific rules and these Terms, the game-specific rules shall prevail with respect to gameplay mechanics, and these Terms shall prevail with respect to all other matters.

5.1 Game Integrity

OpenPH is committed to providing fair and transparent gaming. Digital games on the Platform use certified Random Number Generator (RNG) technology. Live dealer games use physical cards and equipment operated by trained dealers under camera surveillance. OpenPH does not manipulate game outcomes beyond the published house edge applicable to each game.

5.2 Malfunction Policy

In the event of a technical malfunction, game error, or system failure that affects the outcome of a game or the crediting of winnings, OpenPH reserves the right to void the affected round(s) and refund the wager amount to the player's account. OpenPH's decision in such matters is final. No compensation beyond the refund of the original wager will be provided in connection with a technical malfunction.

5.3 Disconnection Policy

OpenPH is not responsible for losses incurred as a result of internet disconnection, device failure, or other technical issues on the player's end during active gameplay. It is your responsibility to maintain a stable internet connection when using the Platform.

6 Bonuses & Promotions

OpenPH may from time to time offer bonuses, free bets, cashback offers, and other promotional incentives to registered players. All bonuses and promotions are subject to specific terms and wagering requirements that will be communicated at the time the offer is made. General conditions applicable to all OpenPH bonuses include:

• Bonuses are available to eligible registered players only and may not be claimed by the same person more than once unless explicitly stated;
• Bonus funds are subject to wagering requirements before they may be withdrawn. The applicable wagering requirement will be specified in the promotion terms;
• OpenPH reserves the right to modify, suspend, or withdraw any bonus or promotion at any time without prior notice;
• Bonuses may not be transferred between accounts or exchanged for cash except as expressly permitted by the applicable promotion terms;
• Any attempt to abuse bonus offers — including but not limited to creating multiple accounts, placing offsetting bets, or exploiting system errors — will result in forfeiture of the bonus and any associated winnings, and may result in account termination.

7 Prohibited Conduct

The following conduct is strictly prohibited on the OpenPH Platform. Engaging in any prohibited conduct may result in immediate account suspension or permanent termination, forfeiture of account balances, and referral to relevant Philippine law enforcement authorities where applicable:

• Registering if you are under 21 years of age or are otherwise ineligible under these Terms;
• Providing false, misleading, or fraudulent information during registration or KYC verification;
• Creating or operating more than one OpenPH account;
• Using the Platform for any money laundering, fraud, or other illegal financial activity;
• Using automated software, bots, scripts, or any artificial intelligence tools to gain an unfair advantage in gameplay or to circumvent Platform security measures;
• Colluding with other players to manipulate game outcomes;
• Exploiting software bugs, errors, or vulnerabilities — any such discovery must be reported to OpenPH support immediately;
• Engaging in chargebacks or payment reversals in bad faith after receiving gaming services;
• Harassing, threatening, or abusing OpenPH staff or other players through any communication channel;
• Attempting to access another player's account without authorization;
• Reproducing, distributing, or commercially exploiting any content from the OpenPH Platform without prior written consent.

8 Intellectual Property

All content on the OpenPH Platform — including but not limited to software, source code, game mechanics, graphics, logos, trademarks, trade names, text, audio, video, and user interface design — is the exclusive property of OpenPH or its licensors and is protected by applicable Philippine and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal, non-commercial entertainment purposes in accordance with these Terms. This licence does not include any right to:

• Copy, reproduce, or distribute any Platform content;
• Modify, adapt, translate, or create derivative works based on Platform content;
• Reverse engineer, decompile, or disassemble any software component of the Platform;
• Use any OpenPH trademark, logo, or brand element without prior written consent.

Any unauthorized use of OpenPH intellectual property will constitute a material breach of these Terms and may give rise to civil and criminal liability under Philippine law.

9 Disclaimer of Warranties & Limitation of Liability

9.1 Disclaimer

The OpenPH Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. OpenPH does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. To the fullest extent permitted by applicable Philippine law, OpenPH disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.2 Limitation of Liability

To the maximum extent permitted by law, OpenPH's total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the Platform shall not exceed the total amount deposited by you into your OpenPH account in the thirty (30) days immediately preceding the event giving rise to the claim.

In no event shall OpenPH be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of or inability to use the Platform, even if OpenPH has been advised of the possibility of such damages.

10 Account Suspension & Termination

OpenPH reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without prior notice, for any of the following reasons:

• Breach of any provision of these Terms;
• Failure to complete KYC verification within the required timeframe;
• Suspected fraud, money laundering, or other illegal activity;
• Receipt of a self-exclusion request from you under our Responsible Gaming Policy;
• A court order, regulatory directive, or law enforcement request;
• Extended account inactivity (accounts inactive for more than 12 consecutive months may be subject to dormancy procedures).

You may close your OpenPH account at any time by contacting our support team. Upon closure, any remaining real-money balance (net of any applicable bonus funds subject to wagering requirements) will be returned to you via your registered payment method, subject to completion of any outstanding KYC requirements.

Termination of your account does not affect any rights or obligations that accrued prior to termination, including any outstanding payment obligations owed by either party.

11 Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

In the event of a dispute between you and OpenPH, we encourage you to contact our support team in the first instance to seek an amicable resolution. If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the competent courts of the Philippines.

OpenPH operates in compliance with applicable PAGCOR regulations. Regulatory complaints may be directed to the Philippine Amusement and Gaming Corporation (PAGCOR) through their official channels.

12 Changes to These Terms

OpenPH reserves the right to amend, update, or replace these Terms at any time. When material changes are made, OpenPH will notify registered players via email or a prominent notice on the Platform at least seven (7) days before the changes take effect, where practicable.

Your continued use of the OpenPH Platform after the effective date of any revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Platform and may request account closure in accordance with Section 10.

We recommend that you review these Terms periodically to stay informed of any updates. The "Last Updated" date at the top of this page indicates when the Terms were most recently revised.
